These PWS Terms and Conditions govern your use of progressiveweldingsolutions.net and purchases made from Progressive Welding Solutions Ltd.. (“PWS,” “we,” “us,” or “our”).

By using this website, creating an account, submitting an order, approving a quotation, or purchasing a product or service, you agree to these Terms and Conditions.

Nothing in these Terms limits any rights provided under applicable consumer-protection law.

  1. SCOPE OF THESE TERMS

These Terms apply to:

  • Stocked physical products.
  • Direct-ship and third-party-fulfilled products.
  • Custom fabrication and special orders.
  • Gates, railings, stairs, security products, and other fabricated systems.
  • Site visits, measurements, consultations, design, delivery, and installation.
  • Digital products, calculators, drawings, guides, and downloadable content.
  • All other products and services offered by PWS.

A written quotation, project agreement, approved drawing, product listing, or change order may contain additional terms. If there is a conflict, the project-specific written agreement will control, subject to applicable law.

  1. WEBSITE USE

You may use this website only for lawful purposes. You must not:

  • Attempt to gain unauthorized access to the website or another customer’s account.
  • Introduce viruses, malicious code, or disruptive software.
  • Copy, scrape, reproduce, or commercially exploit website content without permission.
  • Submit fraudulent orders or payment information.
  • Use the website in a way that violates another person’s rights or applicable law.

PWS may restrict or terminate access when there is evidence of fraud, abuse, security threats, or unlawful activity.

  1. CUSTOMER INFORMATION AND ACCOUNTS

Customers must provide accurate, complete, and current contact, billing, shipping, and project information.

You are responsible for:

  • Protecting your account password.
  • Reviewing your order before payment.
  • Providing a complete delivery address.
  • Providing accurate measurements and project details.
  • Notifying PWS promptly of unauthorized account activity.

PWS is not responsible for delays or additional costs caused by incorrect information supplied by the customer.

  1. PRODUCT INFORMATION

PWS makes reasonable efforts to provide accurate product descriptions, dimensions, materials, colors, photographs, specifications, and availability information.

colors and finishes may appear slightly different because of lighting, screen settings, manufacturing batches, material texture, or normal production variation. Products will nevertheless materially conform to their written description and approved specifications.

Product images may include accessories, tools, backgrounds, or installation examples that are not included unless specifically stated.

  1. ORDER ACCEPTANCE

Customers must be given an opportunity to review and correct their order before completing checkout.

An electronic order confirmation acknowledges and records the customer’s purchase. PWS may contact the customer if:

  • A product is unavailable.
  • The shipping information is incomplete.
  • An obvious pricing or description error occurred.
  • Additional customization or shipping information is required.
  • Fraud or payment verification is necessary.

PWS will not substitute a materially different product without the customer’s approval. If an order cannot be fulfilled, PWS will notify the customer and issue a refund as required by law.

  1. PRICES, TAXES, AND CURRENCY

Prices are displayed in the currency shown on the product page, quotation, cart, or checkout screen.

The final quotation or checkout screen will show, where applicable:

  • Product or service price.
  • VAT or other applicable taxes.
  • Delivery or shipping charges.
  • Customization charges.
  • Any customer-paid duties or import costs disclosed before purchase.

Prices may change before an order is completed. Price changes will not affect an order that has already been accepted, except where the customer approves a change or an obvious error must be corrected.

  1. PAYMENTS

Retail and online orders generally require full payment at checkout unless another arrangement is stated.

Unless a written quotation provides otherwise, custom fabrication and installation projects require:

  • A 60% deposit before design, purchasing, scheduling, or fabrication begins.
  • The remaining 40% before delivery or installation.

Deposits are applied toward project design, materials, scheduling, fabrication, and other committed costs.

PWS may pause work or withhold delivery or installation if a required payment is overdue. This does not remove any rights or obligations provided under applicable law.

  1. CUSTOM FABRICATION AND PROJECT ORDERS

Custom products are manufactured according to approved dimensions, materials, finishes, drawings, and written specifications.

Before fabrication begins, the customer may be required to approve:

  • Overall dimensions.
  • Product configuration.
  • Material type and finish.
  • Design drawings or renderings.
  • Gate direction and operation.
  • Railing layout.
  • Installation location.
  • Accessories and automation equipment.

Approval confirms that the customer accepts the stated design and specifications. It does not remove PWS’s responsibility to provide work that materially conforms to the approved agreement.

Changes requested after approval may require a written change order, additional payment, and a revised completion date.

  1. GATES AND RAILINGS

Unless PWS agrees otherwise in writing, PWS gate and railing systems are provided as complete design, supply, delivery, and installation packages.

Supply-only gate or railing purchases are not offered unless specifically approved by PWS in writing.

The customer must not arrange installation by an unauthorized third party unless the agreement specifically allows it. Unauthorized installation or modification may affect any applicable workmanship or installation warranty but will not remove statutory rights relating to an original product defect.

  1. CUSTOMER-PROVIDED DRAWINGS AND DIMENSIONS

Customer-provided sketches, photographs, measurements, architectural drawings, AI-generated images, and conceptual renderings are treated as reference information only until reviewed and accepted by PWS.

AI-generated images and visual concepts are not fabrication drawings and may contain inconsistent dimensions, impossible connections, conflicting views, or unsafe details.

PWS may:

  • Request additional measurements.
  • Require a site visit.
  • Correct inconsistent or incomplete information.
  • Produce a shop drawing for approval.
  • Refuse a design that is unsafe, impractical, unlawful, or unsuitable for fabrication.

Preliminary online estimates based on customer-supplied measurements are not final quotations unless confirmed in writing by PWS.

If the customer declines a recommended site measurement and instructs PWS to rely on customer-provided dimensions, additional work caused by inaccurate dimensions may require a change order and additional payment.

  1. ENGINEERING AND PERMITS

Engineering calculations, professional certifications, stamped drawings, permits, planning approvals, electrical work, concrete work, or other specialist services are included only when specifically stated in the quotation.

The customer is responsible for obtaining required property-owner approval, planning approval, permits, and other authorization unless the written agreement assigns that responsibility to PWS.

PWS may stop or postpone work that appears unsafe or does not have the necessary authorization.

  1. SITE VISITS AND SERVICES

Site-visit charges vary according to location, access, travel requirements, and project conditions.

A completed site visit, measurement, consultation, design service, or other professional service is non-refundable. If the applicable quotation states that a site-visit fee will be credited toward the project, that credit will be applied according to the quotation.

Customers must provide safe and reasonable access to the work area at the agreed time.

  1. INSTALLATION CONDITIONS

Before installation, the customer must:

  • Provide safe and unobstructed access.
  • Remove vehicles, furniture, animals, and personal property from the work area.
  • Identify known underground, concealed, electrical, plumbing, or utility hazards.
  • Obtain necessary access permission from property owners or occupants.
  • Inform PWS of restrictions affecting delivery or installation.

Unexpected site conditions, concealed damage, unsuitable foundations, inaccurate site information, or work outside the agreed scope may require a change order.

PWS may suspend work when conditions are unsafe. Additional mobilization or delay costs may apply when the condition was not caused by PWS and the charge is reasonable and disclosed.

  1. DELIVERY AND COMPLETION DATES

Delivery and completion periods will be stated on the product page, order confirmation, quotation, or project agreement.

PWS will make reasonable efforts to meet the agreed period. If a delay occurs, PWS will notify the customer and, where required, offer a revised date or refund option.

A customer-requested design change, delayed approval, late payment, restricted site access, inaccurate information, material change, or event outside PWS’s reasonable control may extend the completion period.

  1. DIRECT-SHIP AND THIRD-PARTY-FULFILLED PRODUCTS

Some products are sourced after purchase and shipped directly by a manufacturer, distributor, retailer, warehouse, or other fulfillment partner.

Direct-ship products may:

  • Arrive separately from other items.
  • Ship from another country or region.
  • Have different delivery periods.
  • Display the fulfillment partner’s information on the external packaging.

PWS remains the customer’s primary point of contact.

Customers must contact PWS—not the fulfillment partner—regarding cancellations, returns, damage, incorrect products, missing products, or refunds.

If a direct-ship product becomes unavailable, PWS will offer a revised delivery date, an approved alternative, or a refund.

Customers must not return a direct-ship product to the address shown on its packaging without written return authorization from PWS.

  1. RETURNS, CANCELLATIONS, AND REFUNDS

All returns, cancellations, and refunds are governed by the PWS Refund & Return Policy, which forms part of these Terms.

Customers should contact PWS before returning a product or opening a payment dispute. This does not prevent a customer from exercising any legal right.

  1. DIGITAL PRODUCTS AND DOWNLOADS

Digital products are licensed, not sold, for the customer’s authorized personal or internal business use.

Customers may not:

  • Resell or redistribute digital products.
  • Upload them to file-sharing platforms.
  • Share account or download access with unauthorized persons.
  • Remove copyright or ownership notices.
  • Claim PWS content as their own.

Digital calculators, guides, estimates, drawings, and educational content provide general information. They do not replace project-specific professional engineering, regulatory approval, site verification, or competent trade judgment.

The customer remains responsible for verifying measurements, loads, materials, codes, and site conditions before using digital information for fabrication or construction.

  1. WARRANTIES AND PRODUCT CARE

Any product, manufacturer, fabrication, or workmanship warranty will be stated on the product page, quotation, warranty document, or project agreement.

Customers must follow applicable operating, maintenance, cleaning, inspection, and safety instructions.

Warranty coverage may not apply to damage caused by:

  • Misuse, neglect, or abuse.
  • Incorrect voltage or electrical supply.
  • Unauthorized repairs or modifications.
  • Improper maintenance.
  • Corrosion or environmental exposure beyond the stated product specification.
  • Third-party installation errors.
  • Accidents, vandalism, impact, storms, flooding, or other external events.

These exclusions do not remove rights relating to defects that existed when the product or service was supplied.

  1. INTELLECTUAL PROPERTY

The PWS name, branding, product designs, website content, photographs, drawings, calculators, guides, documents, graphics, and other original materials are owned by or licensed to PWS.

Customers may not reproduce, sell, distribute, manufacture from, or commercially exploit PWS intellectual property without written permission.

Unless a project agreement states otherwise, PWS retains ownership of its standard designs, fabrication methods, templates, calculations, and underlying intellectual property.

After full payment, the customer may use project-specific drawings and documents for the intended project. This does not automatically grant the right to reproduce the design for additional projects or provide it to another fabricator for commercial manufacture.

  1. THIRD-PARTY LINKS AND SERVICES

The website may contain links to third-party websites, payment processors, carriers, manufacturers, or service providers.

PWS is not responsible for unrelated content or activity on a third-party website. However, using a third-party supplier or fulfillment partner does not remove PWS’s obligations to the customer for products purchased directly from PWS.

  1. PRIVACY AND ELECTRONIC COMMUNICATIONS

PWS handles personal information according to its Privacy Policy and applicable law.

By submitting an order, quotation request, or contact form, the customer agrees to receive necessary electronic communications regarding:

  • Orders and payments.
  • Delivery and installation.
  • Quotations and approvals.
  • Returns and refunds.
  • Account security.
  • Customer support.

Electronic orders, approvals, acknowledgments, and communications may be retained as business records.

  1. LIMITATION OF LIABILITY

Nothing in these Terms excludes or restricts:

  • Rights provided under applicable consumer-protection law.
  • Liability that cannot legally be excluded.
  • Liability for death or personal injury caused by negligence.
  • Liability for damage caused by a defective product where exclusion is prohibited.
  • Responsibility for fraud or intentional misconduct.

PWS is not responsible to the extent that loss or damage is caused by inaccurate customer information, unauthorized modification, misuse, improper maintenance, third-party installation, or use outside the product’s stated purpose.

For business customers only, and only to the extent permitted by law and considered reasonable, PWS will not be liable for indirect loss of profit, revenue, production, contracts, or business opportunity. Any permitted limitation will not exceed the amount paid for the affected product or service.

  1. EVENTS OUTSIDE REASONABLE CONTROL

PWS is not responsible for delay caused by events outside its reasonable control, including severe weather, natural disasters, port delays, customs delays, labor disruption, supplier failure, material shortages, transport interruption, public emergencies, or government restrictions.

PWS will notify affected customers and take reasonable steps to reduce the delay. Any cancellation or refund rights required by law will remain available.

  1. DISPUTE RESOLUTION

Customers should first contact PWS at info@progressiveweldingsolutions.net and allow a reasonable opportunity for investigation and resolution.

If the matter cannot be resolved directly, the parties may use mediation, the Saint Lucia Consumer Affairs Department, another appropriate dispute-resolution process, or the courts with jurisdiction.

  1. GOVERNING LAW

These Terms are governed by the laws of Saint Lucia.

Customers located in another jurisdiction may also have mandatory consumer rights under the laws applicable to them. These Terms do not remove rights that cannot legally be excluded.

  1. CHANGES TO THESE TERMS

PWS may update these Terms when business practices, website functions, products, services, or legal requirements change.

The Terms in effect when an order or project agreement is accepted will generally apply to that transaction. Material changes will not be applied retroactively unless required by law or accepted by the customer.

  1. SEVERABILITY

If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue to apply.
